Cohen and Wolf Attorney Kaelyn Mostafa Claims Lemon Law Victory Against General Motors
After an arbitration hearing before the Connecticut Department of Consumer Protection, Attorney Kaelyn Mostafa won a lemon law award of over $100,000 for a Milford resident. The favorable arbitration decision ordered American multinational car manufacturer, General Motors, to refund the Milford resident the purchase price of the vehicle, plus other damages, including attorney’s fees and costs for property damage caused by the vehicle to the client’s garage floors.
On July 31, 2019, the Milford resident purchased a 2019 Chevrolet Corvette Grand Sport from a dealer in East Haven. The Milford resident experienced random no-start episodes, abnormal transmission shifting, and violent lunging/jerking when engaging the gas pedal. After several unsuccessful attempts by the dealer to repair the vehicle, the Milford resident ceased operating the vehicle due to serious safety concerns.
After determining that the Milford resident’s vehicle met the eligibility requirements for relief under Chapter 743b of the Connecticut General Statutes (nicknamed the “lemon law”), Attorney Mostafa filed a complaint with the Department of Consumer Protection. The lemon law arbitration hearing was held on October 6, 2022, and the decision was issued on November 17, 2022 in the Milford resident’s favor.
Attorney Mostafa commented, “The lemon law provides a fast, accessible, and cost-effective process for consumers to pursue claims against big car manufacturers if a new vehicle does not meet their expectations. It really levels the playing field.” Attorney Mostafa further remarked, “My advice would be not to wait – contact an attorney as soon as you notice the issue to set yourself up for success in pursuing your claim.”
Last year, Attorney Mostafa won a similar lemon law award for a New Haven resident in a case against multinational luxury car manufacturer, Jaguar Land Rover.
