Cohen and Wolf Attorney Kaelyn Mostafa Claims Lemon Law Victory Against Mercedes-Benz

05.06.2024

After an arbitration hearing before the Connecticut Department of Consumer Protection, Attorney Kaelyn Mostafa won a lemon law award of over $140,000 for two Plantsville resident-consumers. The favorable arbitration decision ordered German multinational car manufacturer Mercedes-Benz to pay off the consumers’ auto loan and refund them certain expenses, including a portion of the purchase price of the vehicle, rental car costs, and attorney’s fees and costs.

The Plantsville residents purchased a 2023 S580V4 from New Country Mercedes-Benz in Hartford, Connecticut. They experienced multiple spontaneous shutdowns while operating the vehicle, unable to re-start the vehicle after each incident. After several unsuccessful attempts by the dealer to repair the vehicle, the consumers ceased operating the vehicle out of concern for their safety.

After determining that the consumers’ vehicle met the eligibility requirements for relief under Chapter 743b of the Connecticut General Statutes (nicknamed the “lemon law”), Attorney Mostafa filed a complaint with the Department of Consumer Protection. The lemon law arbitration hearing was held on February 20, 2024, and the decision was issued on March 14, 2024 in favor of the consumers.

Attorney Mostafa commented, “The lemon law provides a fast, accessible, and cost-effective process for consumers to pursue claims against big car manufacturers if a new vehicle does not meet their expectations. It really levels the playing field.” Attorney Mostafa further remarked, “My advice would be not to wait – contact an attorney as soon as you notice the issue to set yourself up for success in pursuing your claim.”

In 2023, Attorney Mostafa won a similar lemon law award for a Milford resident in a case against American multinational car manufacturer, General Motors.
